知识产权法的部门归属是关系到国家知识产权战略的重大问题,对于知识产权的法律适用有重大作用。本文在对现有观点进行分析的基础上,指出知识产权法是民法特别法,这对于明确知识产权法的部门归属,加强知识产权保护都有着重要的意义。
